End User License Agreement (EULA) EULA version: 1.3 This English text is a translation provided for convenience. In case of any discrepancy, the Russian version prevails. This agreement (the "EULA") is an offer to the public by Dmitry Vadimovich Grenev, individual entrepreneur (the "Licensor"). Payment for an order constitutes acceptance of the offer and the conclusion of an agreement between the Licensor and the buyer named in the order (the "Licensee"). 1. Subject Matter 1.1 The "Product" means a font, a component library or another product of the Licensor named in the order: for a font, the design of its glyphs and the font files of the ordered styles; for a library, its source code, packages and accompanying materials. The Product comprises all releases with the same number before the first dot as the release current on the date of payment, including later releases, should the Licensor issue any (for example, if release 2.3 is current on the date of payment, all 2.x releases). Releases with a different number before the first dot (for example, 3.0) are separate products and are purchased separately. 1.2 A "Project" means a website, application, service or other digital product in which the Product is used. A Project also includes its mock-ups, documentation and digital materials about it (images, videos, presentations). 1.3 The Licensor makes a one-time delivery to the Licensee of the release of the Product current on the date of payment (via a download link or a private package registry) and grants a non-exclusive worldwide license to the Product for the full term of the exclusive right in it. The fee is payable as a single payment in the amount stated in the order. 2. Rights 2.1 Subject to section 3, the Licensee may use the Product in any way in any number of Projects, including: installing and copying the Product on any devices and servers; keeping it in private repositories and package registries; modifying it; embedding it in Projects, distributing Projects together with the Product and making them available to the public. There is no limit on the number of devices, developers, users or views. The Licensee may also create its own logos and trademarks using the font and may register, use and transfer them without restriction. Crediting the author of the Product is not required. 2.2 The Licensee may allow anyone who works on its Projects (employees, contractors) to work with the Product on those Projects, and may hand over Projects together with the Product to others (clients, acquirers). A person to whom a Project is handed over receives from the Licensor, free of charge, the same license for that Project upon starting to use the Product. 3. Restrictions The license does not grant the right to: — distribute the Product, including in modified form, or products of the same kind derived from it (fonts, component libraries, templates) as a standalone product; — make the files or source code of the Product, or an access token for it, publicly available, including in public repositories (Project repositories included) and package registries, except for the files and code that a published Project delivers to its users for its display and operation; — offer the Product to others as a design option or a building block for projects they create themselves, including in builders, generators and template marketplaces. 4. Liability FOR PERSONS WHO ARE NOT CONSUMERS, THE PRODUCT IS PROVIDED "AS IS", WITHOUT ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, COMPATIBILITY OR FREEDOM FROM ERRORS, AND THE LICENSOR'S LIABILITY TO THEM, EXCEPT FOR INTENTIONAL MISCONDUCT, IS LIMITED TO THE AMOUNT PAID FOR THE PRODUCT. 5. Final Provisions 5.1 If the payment for the Product is refunded or reversed, the Licensee's license ends; licenses obtained by others under clause 2.2 before that remain in force. 5.2 This version of the EULA applies to licenses paid for while it is in effect. A Licensee who paid for a license earlier may apply this version to that license instead of the earlier one. 5.3 The EULA is governed by the law of the Russian Federation. A consumer retains the rights that, under the law of the country of the consumer's habitual residence, cannot be limited by contract. Disputes with persons who are not consumers are heard by the court at the Licensor's place of residence; the Licensor may also bring proceedings in the court at the defendant's place of business or residence. 5.4 The EULA is made in Russian; the English translation is provided for convenience.
